2026 Agility Club Agreement and Waiver
Clever Paws Training LLC (DBA Heather’s Dog School and hereby referred to as HDS)
Owner refers to the dog owner and HDS student signing this document.
Monthly Agility Club Classes
Owner understands that their monthly payment allows access to the weekly class at their appointed day and time. The fee remains the same whether the month has 4 weeks or 5 weeks of classes. For each class missed by the owner, a free one-hour facility rental may be used within 30 days of the missed class in the building where their normal class is held. Owner understands that the monthly fee remains the same whether they attend all the classes or not, and whether they use the facility rental or not, if/when it applies. Payments are not refundable.
Monetary Value of Services and/or Bonuses
Free rentals for missed classes are gifts from HDS as part of the Agility Club Membership, do not have any monetary value, and cannot be traded for any monetary value. Owner understands that for each missed class they will have access to one bonus facility rental, totaling one hour, to be used within 30 days of the missed class. Bonus rentals expire after 30 days and cannot be extended or transferred.
Class Cancellation Policy
Class cancellations are at HDS’s discretion. When the plows are out, roads are salted, and visibility is reasonable, classes will not be canceled. If owner misses a class for any reason, owner receives a free rental as per the terms stated above. There are no make-up classes or instruction for students who miss class when class is being held. HDS will notify students of cancellation as soon as possible. Weather or instructor illness cancellations may be made the same day of class and will be communicated via text and posted on the Facebook page. There are no refunds for cancellations made by HDS. Owner will ensure that the cell phone number provided is able to receive text messages.
Owner understands and agrees that when the instructor is unable to attend and teach class (which is rare), class will still be held with just students and no refund will be given. The time is expected to be used to train your dogs and help each other. If you are late to class and miss the walk-through and group discussion, you will use your turn to walk the course and have any discussion necessary before running your dog.

Session Attendance and Drop-In Policy:
If you need to skip an upcoming monthly session, you must notify HDS in writing at least two weeks before the first class of that session so that your spot can be offered to another student. If you take a monthly session off, drop-ins are not available for the remainder of that month.
Refund Policy
Payments for Agility Club Membership are not refundable. It is the owner’s responsibility to notify HDS, in writing, at least two weeks prior to the first class of any month that they wish to cancel their membership, otherwise owner will be charged for that month with no refund.
Payment
Monthly payment is due on the last class of the preceding month for the upcoming session. Accepted payment methods are cash (preferred), check, or PayPal (woof@heathersdogschool.com). PayPal payments are $145 to cover processing fees. All other payments are $140 per month.
Dog’s Performance
Although HDS will use all reasonable care to teach owner how to train owner’s dog, HDS cannot guarantee or warrant the effectiveness of the training or that the dog will respond adequately to owner’s commands and cues at all times. Owner agrees that HDS will not be liable for any damage, injury, or loss resulting from the dog’s failure to respond to any command(s), cue(s), or behavior modification for which HDS has instructed owner on how to implement.
HDS agrees to instruct owner on how to train owner’s dog in a reasonable manner. However, the effectiveness of the training depends upon many factors over which HDS has no control, including but not limited to: the future health of the dog, the frequency and effectiveness of training reinforcement by the owner, and the degree of training effort made by the owner.
Should the dog injure any person, or should the dog’s failure to respond to any command(s), cue(s), or trained skills result in damage or injury to any property, animal, or person (including the owner), owner agrees to absolve HDS from any and all obligations and to pay for any such damage. Owner further agrees to hold harmless, defend, and indemnify HDS from any and all such injuries, damage, or claims.
Photo/Video/Email Release
HDS reserves the right to use class or lesson videos and photos for educational and promotional purposes, and to contact students via email to announce HDS activities unless stated otherwise.
HDS Facility Use and Rental Rules
1. Barking dogs must be crated within the building. Do not leave barking dogs in vehicles, even with doors and windows closed. We care about our neighbors and this policy is strictly enforced. If any complaint about barking is received from a neighbor during rental times, all rental privileges will be removed immediately and indefinitely.
2. Clean indoor footwear must be worn in the small building at all times. Bare feet, socks, flip flops, high heels, steel-toed work boots, or any similar footwear are unsafe or damaging to our flooring and are not permitted. Indoor running shoes or other ergonomic footwear only.
3. Proper closed-toe shoes, running shoes, or boots must be worn in the agility arena at all times. No crocs, sandals of any kind, or bare feet.
4. This facility is located on a private residence. DOGS ARE TO BE KEPT ON LEASH AT ALL TIMES WHEN OUTSIDE OF THE BUILDING AND FENCE. The only exception is if you are actively swimming your dog in the pond or practicing off-leash walking in the fields or woods when you have the property to yourself. If others are using the facility or on the property, all dogs must remain on leash.
5. Please exercise good judgment when using toys within the facility by not throwing balls toward fencing, walls, the ceiling, or fixtures.
6. Children are always welcome. However, children must be supervised and are not allowed to play on, in, under, or with any dog training equipment at any time while within the facility.
7. Clean up after your dog immediately and dispose of all waste in the appropriate OUTDOOR receptacles. If your dog eliminates within the facility, wait for them to finish so the mess remains in one area. Cleaning includes use of provided cleaning solution as well as wiping up all waste with paper towels. If you cannot clean properly, you must notify HDS so it can be cleaned. Failure to properly clean will result in losing all rental privileges.
8. Abuse is never tolerated. Anyone abusing our facility, equipment, staff, volunteers, fellow trainees, dogs, or other animals will be immediately removed and barred from the facility. This includes NO choke or prong collars, no shock collars, electronic or “e” collars or devices of any kind, no hitting, no yelling/intimidation, no throwing of any objects, or any similar behavior.
9. Dogs displaying aggressive behavior toward staff, volunteers, trainers, children, students, or other dogs may be asked to leave or will be immediately removed from the premises.
10. Turn off all lights AND LOCK THE DOORS before leaving the SMALL BUILDING. If any door is found unlocked after your facility rental, you may lose rental privileges.
11. The AGILITY ARENA will remain UNLOCKED — do not lock it or leave valuables inside.
12. DO NOT MOVE DOG CRATES in the AGILITY ARENA. If you move chairs, put them back by the crate wall.
13. If an agility course is set up when you arrive, you may rearrange the equipment as needed; however, please return all equipment to its original configuration before you leave, as courses are left set up for weekly classes.
14. Please tidy up after you have finished using the building so that other users do not have to spend their rental time doing so.
15. NO SMOKING, vaping, or use of any drugs is allowed in the buildings or anywhere on the property.
16. No muddy or wet dogs are allowed in the SMALL BUILDING. Any dogs that have been in the pond are not allowed in the building until they are completely dry and free of mud. NO WET DOGS are allowed on the agility equipment for your safety.
17. The outhouse is provided as a courtesy. Please clean up after yourself as you would at home.
18. Breaking any of the above rules will result in loss of rental privileges and may result in being barred from classes. One offense is sufficient.
Liability and Waiver
HDS will endeavor to provide a safe environment for the training of owner’s dog and will endeavor to offer only sound, safe, and responsible training and training instructions. However, owner recognizes that HDS is not responsible for any unintentional errors, omissions, or incorrect assertions. Owner understands that the recommendation of any product or service is not a guarantee of their satisfaction with that product or service. Owner understands they and their dogs will be on natural surfaces in the arena and outdoors and owner fully accepts the risk of injury to both owner and their dogs inherent in walking and running on natural surfaces that may be uneven or contain rocks, roots, and other materials that may be unknowingly present. Further, owner is and will remain responsible for the actions of their dog at all times.
Owner hereby agrees to defend, indemnify, and hold harmless HDS, its officers, directors, instructors, agents, employees and/or representatives from any and all claims, or claims by any member of owner’s family, accompanying guests of owner, or any third party or animal, of injury, expense, costs, or damages caused by the actions of owner’s dog while under HDS’s instruction or control and/or under owner’s care as a result of following training instructions or as a result of walking and running on natural surfaces. Owner has been informed of and understands and assumes the inherent risks of owning a dog, including but not limited to the risk of dog bites to owner or others.
In addition, owner agrees to defend, hold harmless, and indemnify HDS for any injury, expense, costs, or damages to any dog handlers or dogs, whether sponsored by owner or not, or to any third party arising out of use of the facility, owner’s own actions or omissions, the actions of owner’s dog, or of any family member or guest of owner at the facility and/or anywhere on the property. Owner has read the above-stated provisions and agrees to accept those responsibilities.
Any use of the property, including the trails, field, woods, and the pond, is entirely at owner’s own risk. Dogs may be off leash in these areas only when owner has exclusive use of the property during a scheduled facility rental and no other students, classes, or dogs are present. Dogs must remain on leash during all class times and during any period when other students or dogs may be on the property. HDS is NOT responsible for any injury, damage, or loss of owner’s personal property or dog due to wild animals, free-roaming dogs in the neighborhood, trespassers or others using the property, or if a dog runs off and cannot be recalled or found.
By using the pond (whether intentionally or accidentally), owner understands the inherent risk of drowning for both owner and/or the dog, and that there are potentially unknown risks of algae, bacteria, viruses, and/or old fish hooks present in the water. Use of the pond is entirely at owner’s own risk. HDS has no information and has no way of knowing or guaranteeing the water is safe. No lifeguards, supervision, or assistance will be provided.
